Buying properties on Costa del Sol in Spain

The procedure of buying properties in Spain is not very complicated and here is a summary of the different stages. Seeking professional advice is certainly recommended as there may be debts linked to the property or wrong information in the Property Registry, which have to be corrected before you take possession of the property.

1. Reservations Contract

This is a simple document which confirms price and conditions of payment and a smaller sum of 3 000 - 6 000 Euros depending of the price of the property is paid as a reservation fee. The seller will then take the property off the market during a reservation period stated in the document, of normally between 8 - 14 days. During this time information will be obtained to check if the description of the property in the Property Registry is correct. The reservation fee is immediately refundable should there be discrepancies and the seller wants to pull out of the sale.

2. Private Purchase Contract

When the private purchase contract is signed, a deposit of 10% of the price is paid (if no other agreement has been made by reservation). This document is a detailed description of the property, the purchase conditions and other agreements regarding the purchase. The Private Purchase Contract is legally binding for both seller and buyer.

3. Completion

The closing of the purchase takes place at the Notary's Office, where both parties or often who then have power of attorny will sign the official property transfer. The balance of the purchase price is paid to the seller. The keys to the property are handed over and the buyer can take possession of the property.

4. Registration of Ownership

Following the signing of the property transfer, all costs, fees and transfer tax (approx. 10% of the purchase price and 12% if there is a mortgage) will be paid and the Title Deed of Purchase registered at the Land Registry.

Transfer of supply contracts and change of ownership have to be made in the Town Hall and it will take around 2 months to receive the original and registered Title Deed of Purchase.
